Terms of service

  1. General Terms and Conditions

    This notice is intended to provide the consumer with information, prior to entering into a contract, about the detailed rules governing contracts with Bencze Szőlőbirtok Kft., within the scope defined by Government Decree 45/2014 (II.26.)(hereinafter the “Decree”).

    These General Terms and Conditions regulate the legal relationship between Bencze Szőlőbirtok Kft. (Company reg. no.: 19-09-520771, Tax number: 27083455-2-19, registered office: 8265 Hegymagas, Kossuth Street 9., hereinafter the “Service Provider” or “Company”) and the consumer who enters into a contract with the Company as specified in this agreement.

    According to Section 11(6) of the Decree, this notice forms an integral part of the contract.


    Definitions

    a) Consumer: a natural person acting outside the scope of their profession, independent occupation, or business activity.

    b) Consumer dispute: any dispute relating to the quality or safety of a product, the application of product liability rules, the quality of a service, or the conclusion and performance of a contract between the parties.

    c) Consumer contract: a contract concluded between a consumer and the Company.

    d) Warranty: a guarantee as defined by Act V of 2013 on the Civil Code (hereinafter “Civil Code”) for the proper performance of the contract, voluntarily provided by the Company beyond or in the absence of statutory obligations, as well as the mandatory statutory warranty.

    e) Service contract: any contract other than a sales contract under which the Company provides a service or undertakes to provide a service to the consumer, and the consumer pays or undertakes to pay the consideration for the service.

    f) Distance contract: a consumer contract concluded under a distance selling system for the supply of the product or service in which the parties are not physically present at the same time and communicate exclusively using means that allow distance communication.

    g) Means enabling distance communication: any tool that allows the parties to make a contractual declaration without being physically present. This includes, in particular, addressed or unaddressed printed forms, standard letters, order forms in advertisements, catalogs, telephone, fax, and internet-based communication tools.

    h) Product: a movable item; in these General Terms and Conditions, it refers to the goods specified under the relevant product section.

    i) Company: a legal entity acting within the scope of its business activity, as specified in this contract.

    j) Off-premises contract: a consumer contract

    1. concluded at a location other than the business premises of the Company while the parties are physically present;

    2. for which the consumer made an offer to the Company under the circumstances in point (1);

    3. concluded immediately after the Company, in the presence of the consumer, personally and individually contacted the consumer outside its business premises, or using means that enable distance communication; or

    4. concluded during a trip organized by the Company for the purpose of selling or promoting products or services to consumers.



    Products, Services, and Prices Covered by the Contract

    Through the website operated by Bencze Szőlőbirtok Kft. (https://leesbrothers.hu/), consumers can select and purchase wines, sparkling wines, and other alcoholic beverages. Detailed information about essential product characteristics—such as the producer, manufacturer, wine-growing region, and alcohol content—is provided at the time of selection and upon finalizing the order.

    Consumers can also purchase tickets via the website to participate in events organized by Bencze Szőlőbirtok Kft..

    For wines, sparkling wines, and other alcoholic beverages listed for sale, the price shown on the website (per bottle) is the non-discounted bottle price. All prices include VAT (27% for wines).

    Shipping costs are not included in the listed prices. Detailed information about shipping fees and methods is provided in Section 7.


    Essential Characteristics of the Products and Services

    The range of products offered for sale by the Company can be viewed on its online store, and the specifications and prices of each product are available by clicking on the individual product. The product specifications include all essential characteristics, which are also presented on the product detail pages.

    In addition, the Company operates an online system primarily for the purchase of tickets to cultural and other events organized by the Company.


    Order Procedure

    Purchases through the online store are made electronically in accordance with these Terms and Conditions. All orders and contracts are concluded in Hungarian.

    Bencze Szőlőbirtok Kft. reserves the right to verify the accuracy of the information provided by the consumer at the time of purchase. If the provided data is found to be false, questionable, or unintelligible, the Company reserves the right to cancel the order.

    Orders are accepted only from:

    • natural persons over 18 with a registered address in Hungary, phone number, and email;

    • legal entities registered in Hungary with a registered office (delivery address); or

    • unincorporated organizations with a registered office in Hungary.

    Orders placed in the name of another person will not be accepted.



    Registration

    Registration is not required to make a purchase. Consumers may register by providing an email address and password, which allows easier management of orders.

    Details about registration, its purpose, and conditions are described in the Company’s Privacy Policy.


    Ordering Wines, Sparkling Wines, and Other Alcoholic Beverages

    1. The consumer selects products from the website, either via the “OUR PRODUCERS” or “SHOP” menu, and adds them to the shopping cart.

    2. By clicking “Add to Cart”, the product is temporarily reserved. The item remains in the cart for one (1) hour(sometimes two), during which the same item may only be purchased by others if stock allows. If the product is not purchased within this time, it will be removed from the cart and become available to other customers.

    3. The shopping cart displays the selected products, quantities, unit prices, and the total payable amount, excluding shipping costs.

    4. To modify the cart, use the quantity selector for each product or click the “X” next to the item to remove it.


    Purchasing Tickets for Company Events

    Tickets for events organized by Bencze Szőlőbirtok Kft. can be accessed via the “EVENTS” button on the website. Detailed information about each event is available by clicking the “Learn More” button.

    Ticket Purchase

    If you select an event under the “EVENTS” menu on the website, you will automatically be redirected to the “SHOP”page.

    1. Select the event you wish to attend. On the website operated by Bencze Szőlőbirtok Kft., access the event via the “SHOP” menu and add it to your shopping cart.

    2. By clicking “Add to Cart”, the ticket is temporarily reserved. The ticket remains in the cart for one (1–2) hour(s). During this time, the same ticket may only be purchased by others if stock allows. If the ticket is not purchased within this period, it will be removed from the cart and made available to other customers.

    3. The cart displays the selected tickets, quantities, unit prices, and the total amount payable by the customer.

    4. To modify your cart, use the quantity selector next to each product or click the “X” to remove it.


    Finalizing the Order

    1. Proceed to checkout by clicking “Proceed to Checkout”.

    2. Complete the order form, select a payment method, and provide shipping and billing addresses. Review the order summary, which now includes selected products, quantities, unit prices, total price, and shipping costs.

    3. During the ordering process, you may correct any errors in the electronically entered information (e.g., product type, quantity, personal data, shipping address, etc.).

    If the order form is incomplete or contains errors, an error message will appear explaining the issue, and no binding offer is created.

    Finally, review all entered information and click “Submit Order”.


    Order Confirmation

    Order details will be automatically confirmed within 48 hours via the email address you provided, allowing you to verify all information. Your order is recorded under the order number provided in the confirmation.

    A contract between the parties is concluded once:

    • all mandatory fields on the order form are completed and verified by the customer,

    • the customer confirms by clicking the “Submit Order” button, sending the order electronically to the Company, and

    • the Company provides written confirmation of the order electronically.

    The Company’s order confirmation always includes:

    • the ordered product(s) and quantities,

    • the selected shipping and payment methods,

    • the product price and shipping costs, and

    • the expected delivery timeframe as provided by the Company.

    According to Section 6:7 (3) of the Hungarian Civil Code (Ptk.), the written contract qualifies as a formal contract.

    The contract language is Hungarian. It is stored in the Company’s online system for future access and sent to the email address provided by the customer.

    The gross price of the selected product is displayed during the ordering process. Carefully review the total gross value before submitting your order.

    Additional shipping costs are limited exclusively to delivery fees, as detailed in the “Product Pickup/Delivery” section.


    Restrictions on Product or Service Use

    • Alcoholic beverages may only be delivered to customers over 18 years of age.

    • If the recipient cannot conclusively verify their age, the product cannot be legally handed over. Such failed delivery is treated as unsuccessful for reasons attributable to the customer.

    • Re-delivery attempts must follow the applicable procedure of the chosen delivery service. Alcoholic beverages may only be delivered to adults on any subsequent delivery attempts.

    Product Receipt

    a) Delivery

    • We provide delivery of products throughout Hungary, either to your home or to a postal collection point. The shipping address may differ from the billing address. The delivery method is selected during checkout. After the contract is concluded, the shipping address cannot be modified.

    • Shipping costs are automatically calculated by the system based on the delivery address. Please review the expected shipping cost carefully before finalizing your order.

    • Orders are delivered within 7 business days at the latest.

    • Delivery will be made at a pre-agreed time with you.

    • The delivery fee applies to a single delivery to a domestic (Hungarian) address.

    Receipt Requirements:

    • The customer must inspect the packaging for damage upon receipt. Any damage must be documented on-site in a delivery report.

    • After unpacking and confirming proper delivery, the product should be accepted by signing the delivery note, acknowledging the completion of the delivery, including its location and time.

    • Once accepted, the Supplier does not accept complaints regarding deficiencies.

    • The Supplier ensures proper and transport-safe packaging. If visible damage is present upon delivery, the recipient may refuse acceptance, noting the reason on the delivery note and signing it.

    • Any damage occurring during transport is the responsibility of the carrier under a separate contract between the Supplier and the carrier.

    Failed Delivery:

    • If the courier is unable to contact the customer and cannot deliver the product, the contract is considered terminated. If the purchase price was already paid, it will be refunded to the provided bank account.

    • The Supplier is not responsible for delivery delays or issues caused by incorrect, incomplete, or inaccurate information provided by the customer, such as an inaccessible address.


    b) Personal Pickup

    • Personal pickup of products is not possible.


    c) Tickets for Events

    • E-Ticket Delivery: After purchase, the company sends an email to the customer containing the e-ticket in PDF format.

    • If purchased as a registered user, the ticket is also accessible in the user account on the website and can be downloaded at any time.

    • The e-ticket is a full, valid electronic ticket. It contains all information required for admission. Payment confirmation and e-ticket delivery occur virtually immediately.

    • Tickets cannot be collected in person at the event. Customers are responsible for printing or presenting the ticket on a compatible smartphone.

    • The customer assumes full responsibility for any loss, theft, incorrect printing, duplication, or multiple copies of the e-ticket.

    • The Supplier will take all reasonable steps to notify customers in case of event cancellation and to facilitate ticket refunds. Information about ticket refunds will be promptly posted on the website.


    Complaints and Withdrawal

    • The Supplier is fully responsible for the ordered goods until delivery.

    • Damaged or faulty goods will be replaced or supplemented at the Supplier’s expense within 5 working days.

    • The customer may withdraw from the order due to faulty delivery or damage during transport under the conditions set forth below. Paid amounts will be refunded according to the contractual terms.

    • Customers are entitled to resolve consumer disputes out of court through the conciliation board, particularly if attempts at settlement fail.

    • The competent conciliation board is determined by the customer’s residence, the company’s registered office, or the authorized representative’s seat.

    Right of Withdrawal

    • The customer may withdraw from the contract within 14 days without justification or setting an additional deadline.

    • The 14-day period starts on the day the customer or a designated third party (other than the carrier) receives the product, or, in case of multiple items, on the day the last item is received.

    • To exercise the right of withdrawal, the customer must send a clear statement via mail, fax, or email to:

    Right of Withdrawal

    • To exercise the right of withdrawal, you may use the withdrawal form provided in Annex 2 of the Regulation.

    • If you wish to withdraw, complete the form and send it to one of the following addresses:

    "I/We hereby give notice that I/we withdraw from my/our contract for the purchase of the following product(s): (Insert product description). Date of receipt: Consumer name(s): Consumer address(es): Consumer signature(s) (only for paper form). Date:"

    • You exercise your right of withdrawal in time if you send your withdrawal notice before the 14-day period expires. You may also exercise your right to withdraw between the date of conclusion of the contract and the date of product receipt.

    • If you withdraw from this contract, we will refund all payments received from you, including shipping costs, without undue delay and no later than 14 days from receipt of your withdrawal notice (except for additional costs incurred if you chose a shipping method other than the least expensive standard option offered).

    • Refunds are made using the same payment method used in the original transaction, unless you explicitly agree to a different method. No fees are charged for the refund.

    • Refunds may be withheld until the product is returned or proof of shipment is provided, whichever occurs first.

    • You must return the product to us (or to a person authorized to receive it) without undue delay, and no later than 14 days after notifying us of withdrawal. The deadline is met if the product is sent before the 14-day period expires.

    • Return shipping costs are borne by you.

    • The right of withdrawal cannot be exercised for products that have been unsealed after delivery if they cannot be returned for health or hygiene reasons.


    Warranty and Product Liability

    Product Warranty

    • In case of a defective product, you may assert a warranty claim at your discretion.

    • A product is defective if it does not meet the quality requirements in effect at the time of sale or does not possess the properties described by the manufacturer.

    • You may primarily request repair or replacement. For most products we sell (wine, sparkling wine, and other alcoholic beverages), only replacement is possible, due to the impracticality of repair.

    • Warranty claims can be made within two years from the product’s release to the market, but only within the product’s indicated shelf life. After this period, the right expires.

    • Warranty claims may be enforced against the manufacturer or distributor. The customer bears the burden of proving the defect.

    Manufacturer’s Liability Exemptions

    • The manufacturer or distributor is exempt from warranty obligations if they can prove that:

      1. The product was not manufactured or marketed in the course of business, or

      2. The defect was not detectable at the time of sale based on scientific and technical knowledge, or

      3. The defect results from mandatory legal or regulatory requirements.

    • Proving just one of the above is sufficient for exemption.

    • Note: You may not assert statutory warranty and product warranty claims simultaneously for the same defect. However, if a warranty claim is successful, you may enforce a statutory warranty claim on the repaired or replaced product against the manufacturer.

    Warranty (Kellékszavatosság)

    • In the event of defective performance by our company, you may assert warranty claims against the company according to the Civil Code.

    • You may choose to request repair or replacement, except if fulfilling the selected claim is impossible or would result in disproportionate extra costs for the company compared to fulfilling a different claim.

    • If you do not request repair or replacement, or cannot request it, you may instead:

      • Request a proportional reduction in the price,

      • Repair the defect yourself at the company’s expense, or have it repaired by a third party, or

      • Ultimately withdraw from the contract.

    • You may switch from one type of warranty claim to another, but you bear the cost of switching, unless justified or caused by the company.

    • You must notify the company of the defect immediately upon discovery, but no later than 2 months after identifying it.

    • Warranty claims must be made within 2 years from the completion of the contract, after which they cannot be enforced.

    • If the claim is made within 6 months of delivery, no further proof is required beyond notifying the company. After 6 months, you must prove that the defect existed at the time of delivery.

    • Due to the nature of our products, we do not provide additional guarantees.


    Payment Terms

    • You may choose the payment method at the time of order.

    • Orders may be paid via:

      • Bank transfer, or

      • SimplePay system securely through the OTP Bank website using accepted card types.

    • Your personal information (Name, Phone number, Email, Billing address, Shipping address) stored in the Bencze Szőlőbirtok Kft. database will be transmitted to OTP Mobil Kft. as the payment processor. The purpose and scope of data processing are available here: SimplePay Privacy Policy.

    Accepted credit cards:

    • MasterCard (embossed)

    • Visa (embossed)

    • The issuing bank determines whether internet usage of the card is allowed. For details, contact your bank.

    Steps for card payment:

    1. Select products on the webshop and choose to pay by credit card.

    2. You will be redirected to OTP Bank’s secure payment page, where you enter your card details.

    3. Click the Pay button to initiate the transaction.

    4. After payment, you will return to the webshop page to receive confirmation of the transaction.

    Important Notes:

    • Successful transactions occur only if you are redirected back to the webshop from the bank page.

    • Closing the browser or using “Back/Refresh” during payment may cause the transaction to fail.

    • The webshop and the bank operate as separate systems: the company does not see your credit card information, and OTP does not receive your personal registration data from the webshop.

    • Payment security is ensured via SSL protocol on OTP’s platform.

    • You can also pay by card directly to the courier upon delivery.

    Online Card Payment Security – Verified by Visa / MasterCard Secure Code

    • To enhance the security of online card payments, OTP Bank has introduced the Verified by Visa / MasterCard Secure Code (VbV/MSC) service.

    • This service provides the cardholder with an additional verification step during payment, which confirms the identity of the card user.

    • If your card does not support VbV/MSC or you have not activated it, the payment process remains unchanged.

    • You will be redirected to the OTP Bank payment page, where you enter your card details (number, expiration date, CVV) to complete the payment.

    • If your bank supports VbV/MSC and you use it, OTP Bank will automatically redirect you to your issuing bank’s page to complete the verification process.

    • After successful verification, the payment transaction continues, and you will be notified of the success and redirected back to the webshop.

    • If verification fails, the transaction will not be completed.

    • The company does not store your card information at any time, before, during, or after the transaction.


    Bank Transfer Payments

    • Registered business customers may pay via bank transfer within 8 days.

    • Minimum order amount for transfer: 50,000 HUF.

    • Bank account for payment: 10403428-50526852-48751004

    • Payment is considered complete once funds are received within 3 days of the order.

    • Failure to pay within this period may result in non-delivery of products.

    • Ownership of the products remains with the seller until full payment is received, according to Hungarian Civil Code §6:216 (1).

    • After placing the order, the webshop will provide instructions for completing the bank transfer, and you will receive confirmation once the payment is received.


    Discount Coupons

    • Coupon codes are issued by Bencze Szőlőbirtok Kft. and may be published via:

    Coupon Use Terms:

    1. Value: The coupon grants the user a percentage discount on the regular gross price of products available on the webshop.

    2. Validity: Only valid for the period indicated on the coupon.

    3. Products: Applicable to products available on the webshop during the coupon’s validity.

    4. Usage: The coupon may be used unlimited times within its validity period.

    5. Redemption:

      • Select desired products on the webshop.

      • Add products to your virtual cart using the “Add to Cart” button.

      • You do not need to register to add items to the cart.

      • Review your cart with the “View Cart” button, checking products and gross prices (excluding shipping).

      • Enter the coupon code in the “Coupon Code” field and click “Apply Coupon” to automatically apply the discount to your total (shipping and cash-on-delivery fees are not included).

      • After applying the coupon, proceed to checkout via “Proceed to Checkout”, where you can review your final order and enter the coupon code again if needed.

    Additional Important Information

    Before making a purchase, please read the webshop’s guide, the terms and conditions of purchase, and the delivery and payment terms.

    • Review the webshop’s security conditions, which ensure the safety of your personal data.

    • Keep a record of all information related to your purchase.

    • Maintain records of payment transactions (transaction ID, authorization number).

    • Ensure that your card details remain confidential and are never accessible to unauthorized persons.

    • Use a browser that supports SSL encryption to protect your data during online transactions.


    Contract Duration and Business Identity

    • The contract terminates upon mutual performance of the services, according to Hungarian Civil Code §6:3(a).
